Résumé: This research deals with one of the important topics in the Algerian family code, represented in the actions of the patient death disease, which is one of the topics worth discussing as it aims to demonstrate the importance of the behavior of the patient with the disease of death by identifying the most important provisions of the behavior of the patient of death with regard to matters of personal status such as marriage and divorce,as well as what is related to contracts of donation from a will and a gift , on the basis of proposing the following problem: What is the legal system of the actions of the patient's disease death in matters of personal status and donation contracts, according to the Algerian family code by comparing the Islamic Sharia law? This topic has been studied by following the descriptive and analytical approach to answer the problem at hand as I reached several conclusions, the most important of which is in keeping with the Algerian family code and what the Islamic Sharia has brought in the provisions approved by the legislator on this subject.
