التديين "دراسة فقهية مقاصدية"

Résumé: حاولت هذه الدراسة مقاربة موضوع التديين لا كما هو معروف عند الفقهاء، بل حاولت تناوله بطريقة أشمل؛ حيث تناولت التديين بمفهومه العام الذي يعني أن يوكل الإنسان إلى دينه، متتبعة في ذلك عديد الأحكام الفقهية في الفروع والأصول التي تهدف بمقاصدها إلى تديين الناس. وقد توصل البحث عبر محاوره الثلاثة التي تمت من خلاله الدراسة إلى ضرورة التديين بحكم أنه يضفي بعدا أخلاقيا على حياة الناس ويجعلها أقرب إلى مراقبة الله وخشيته، إضافة إلى كون التديين في بعده الاخلاقي يمثل خصوصية إسلامية يرتقي تبرز رقي الإسلام في نصوصه وقواعده، وممارسة أتباعه على بقية النظم والقوانين الوضعية، ذلك أن التديين يمثل نمط الإسلام وصيغته الفريدة، صِبْغَةَ اللَّهِ وَمَنْ أَحْسَنُ مِنَ اللَّهِ صِبْغَةً} [البقرة: 138]. This study attempted to approach the issue of religiosity, not as it is known to the jurists, but rather tried to deal with it in a more comprehensive way. Where she dealt with religiosity in its general sense, which means to entrust a person to his religion, following in that many jurisprudential rulings in the branches and assets that aim with their intentions to make people religious. The research reached through its three axes, through which the study was conducted, the necessity of religiosity as it adds a moral dimension to people’s lives and makes them closer to observing and fearing God.
