الصبي المميز بين الشريعة الإسلامية والقانون الوضعي

Résumé: ملخص: يتفق جميع فقهاء القانون والشريعة الإسلامية على أن مناط أهلية الأداء هو التمييز والعقل، لأن التمييز هو الذي يجعل الشخص مدركا لعباراته فاهما ما يقصد بها وما ينتج عنها. إلا أن هذا التمييز يوجد في الإنسان على التدريج شيئا فشيئا إلى أن يبلغ درجة الكمال، ومن ثمة ارتبطت أهلية الأداء بهذا التمييز تدور معه وجودا وعدما بنفس القدر، فإذا اكتمل التمييز بأن بلغ الشخص سن الرشد ثبتت له أهلية آداء كاملة، وإذا انعدم هذا التمييز انعدمت معه أهلية الأداء. أما ما بينهما "الصبي المميز" فإنه تثبت له أهلية أداء قاصرة. هذه الأهلية القاصرة تجعل تصرفاته النافعة نافذة، والضارة باطلة، أما الدائرة بين النفع والضرر، فقانون الأسرة يعتبرها موقوفة على إجازة الولي أو الوصي –حسب الأحول- موافقا في ذلك فقهاء الشريعة الإسلامية. بينما القانون المدني يجعلها قابلة للإبطال منتهجا في ذلك نهج القانون الغربي. Abstract: All the jurists of Islamic law and Sharia agree that the criteria for the competence of performance is discrimination and reason, because discrimination is what makes a person aware of his phrases, so he understands what is meant by them and what results from them. However, this distinction is found in a person gradually, until he attains the degree of perfection, and from there the competence of performance is linked to this distinction, and it is equally present and absent. With him the eligibility to perform. As for what is between them, the "discerning boy", it proves his eligibility for a minor performance. This minor capacity makes his beneficial actions effective, and harmful actions null and void. As for the circle between benefit and harm, the family law considers it dependent on the authorization of the guardian or guardian - according to the case - according to Islamic law scholars. While civil law makes it revocable, following the approach of Western law.
