عناصر القصد الجنائي في الجريمة السلبية دراسة مقارنة بين الفقه الإسلامي والقانون الجزائري

Résumé: يعتبر القصد الجنائي أحد صورتي الركن المعنوي للجريمة، فهو يعبر عن الإرادة الحقيقية للجاني عند ارتكابه للجريمة، ويحظى بأهمية كبيرة في الفقه والقضاء على حد سواء، وبناء على هذا الأمر جاءت دراستنا مقارنة بين الفقه الإسلامي والقانون الجزائري، حيث تم التطرق لمفهوم القصد الجنائي عند أهل اللغة مرورا بفقهاء الشريعة وانتهاء بفقهاء القانون، وكذلك تم التعرف على عناصر القصد الجنائي: العلم والإرادة، وتعريف كل منهما وإظهار أهميتهما في الفقه الإسلامي والقانون الجزائري، وتم الاعتماد في الدراسة على المنهج المقارن الوصفي والمنهج المقارن . Résumé : L’intention criminelle est l’une des formes de l’élément moral du crime, elle reflète la véritable volonté du délinquant lorsqu’elle commet le crime et elle revêt une grande importance tant pour la jurisprudence que pour la jurisprudence. En plus d’identifier les éléments de l’intention criminelle : la connaissance et la volonté, ainsi que la définition de chacun d’eux et leur importance dans la jurisprudence pénale islamique et la législation algérienne, l’étude était fondée sur une approche comparative et une approche descriptive. Abstract: Criminal intent is one of the elements of the moral corner of the crime, it reflects the true will of the offender when committing the crime, and is of great importance in the jurisprudence and the judiciary alike, and based on this matter came our comparison between Islamic criminal jurisprudence and Algerian legislation, where the concept of criminal intent was addressed when The people of the language, through the jurisprudence of the Shari'ah and the jurisprudence of the law, were also identified elements of the criminal intent: science and will, and the definition of each and demonstrate their importance in Islamic criminal jurisprudence and Algerian legislation, and the study was based on the comparative and descriptive approach.
