البناء غير القانوني في التشريع الجزائري بين إجراءات التسوية والمتابعة الجزائية

Résumé: سعيا من المشرع لتدارك ظاهرة البناء غير القانوني وحماية النسيج العمراني للمدن، فقد أصدر مجموعة من النصوص القانونية والتنظيمية منها ما يتعلق بمعالجة وتسوية البنايات المخالفة لأحكام قانون التعمير، ومنها ما يتعلق بتجريم الأفعال المتعلقة بهذه البنايات، ويهدف كل من النظامين الى فرض قانون التعمير اما بواسطة نصوص قانونية علاجية تستهدف إمكانية مراجعة المخالفات التي يرتكبها أصحاب مشاريع البناء، أو من خلال تطبيق قواعد قانونية ذات طابع جزائي بغرض ردع الممارسات التي تنتهك قانون التعمير، وهو الأمر الذي سنحاول معالجته في هذه الدراسة من خلال تسليط الضوء على الاطار القانوني للبناء غير القانوني وكذا مختلف الإجراءات القانونية والتنظيمية التي تهدف الى تسويته او متابعة مرتكبيه جزائيا، مع طرح لأهم النتائج المتوصل إليها. In an effort to remedy the phenomenon of illegal construction and protect the urban fabric of cities and promulgated a series of legal and regulatory texts, including on the treatment and settlement of buildings contrary to the provisions of the Reconstruction Act; These include the criminalization of acts relating to these buildings, both of which have the aim of imposing the Reconstruction Act, either by means of remedial legal provisions aimed at reviewing the wrongdoing of the construction entrepreneurs, or through the application of legal norms of a penal nature for the purpose of deterring practices that violate the Reconstruction Act legal framework for illegal construction, as well as various legal and regulatory actions aimed at settling it, or pursuing its perpetrators in a criminal manner, with the most important findings.
