حماية الأسرة في ظل صياغة النص القانوني وإشكالات التطبيق - الحكم القاضي بالطلاق نموذجا- (مداخلة الملتقى)

Résumé: ملخص: لقد أثار الحكم القاضي بالطلاق جدلا واسعا في الوسط القانوني على غرار بعض المواضيع الأخرى في قانون الأسرة الجزائري، بعدما أفرزه من إشكالات قانونية برز بشأنها نقاش واسع لم يحسم بعد، بعض هذه الإشكالات حملت في طياتها اختلافا كبيرا مع بعض الأحكام الشرعية التي أقرها الفقه الإسلامي لإرساء دعائم الأسرة والمحافظة عليها، فأضحت تشكّل وسيلة حالت في عديد الحالات دون حماية هذه الأسرة لتعلقها بمسائل تصنّف ضمن النظام العام. لذا فقد بات من الضروري تدارك هذه المسألة من خلال إعادة صياغة النصوص القانونية بما يزيل الجدل حول طبيعة الحكم القاضي بالطلاق ودوره في المحافظة على الأسرة وحمايتها، تماشيا وأحكام الفقه الإسلامي.
