حماية حقوق الطفل في المواثيق الإقليمية بين تكريس الخصوصية ودعم الفعالية

Résumé: إذا كانت المواثيق الدولية المعنية بحماية حقوق الطفل تسعى لتكريس هذه الحماية بغض النظر عن الدولة التي ينتمي إليها الطفل وبغض النظر عن البيئة الاجتماعية والثقافية التي يتواجد بها، فإن المواثيق الإقليمية تراعي في حماية الطفل القيم الإقليمية المشتركة وخصوصيات المجتمع المحلي الذي يتواجد فيه من النواحي الاقتصادية والاجتماعية والثقافية، ولا يخفى ما لاختلاف هذه الأخيرة من تأثير على اختلاف معايير تطبيق حقوق الإنسان بصورة عامة وحقوق الطفل بصورة خاصة، مما يساهم في دعم منظومة حماية حقوق الطفل العالمية بمنظومة إقليمية أكثر تخصصا تركز على الجوانب التي لم تتطرق لها المعايير العالمية. Abstract: the international charters of the protection of the rights of the child seek to concretize this protection whatever the country to which the child belongs and whatever the social and cultural environment in which he resides, so the regional conventions for the protection of the child take into account the common regional values and the specificities of the local community in which he is present, economic, social and cultural, and that the effect of their differences on the various application criteria is not hidden. human rights in general and the rights of the child in particular, which helps to support the global child rights protection system with a more specialized regional system based on aspects that have not been treated by global standards.
