سياسة المشرع الجزائري في مجال مكافحة جرائم البيئة

Résumé: ملخص تعتبر الجريمة البيئية من أهم الجرائم المستحدثة التي ظهرت مؤخرا التي تشغل مجالا واسعا بسبب سرعة انتشارها وامتداد أثرها للإنسان، ولكن على أساس اصطلاحي فهي تعتبر دخيلة نوعا ما على مفرداتنا فرغم ترسانة القوانين المتعلقة بالبيئة إلا أن المتمعن فيها يجد صعوبة للإلمام بها لوجود جوانب تقنية وفنية بها تتجلى أهمية دراسة موضوع سياسة المشرع الجزائري في مكافحة الجريمة البيئية في عدة اعتبارات أهمها حداثة الدراسات القانونية في نطاق حماية البيئة، حيث لم يبرز اهتمام العالم بها جديا إلا بعد منتصف القرن العشرين، بالإضافة الى تدعيم مبدأ الشرعية الجنائية عن طريق تبيان الأركان العامة للجريمة البيئية و التي ستساهم بطريقة فعالة في التقليل من انتهاك قواعد التشريع البيئي ، وخيرا وليس اخرا معرفة كيف واجه المشرع الجزائري القائمين على تهديد البيئة. Abstract Environmental crime is considered one of the most important new crimes that have appeared recently, which occupies a wide area due to the speed of its spread and the extension of its impact on humans. However, on a terminological basis, it is considered somewhat alien to our vocabulary. Despite the arsenal of laws related to the environment, those who examine it find it difficult to become familiar with it because of its technical and technical aspects. The importance of studying the issue of the Algerian legislator’s policy in combating environmental crime is evident in several considerations, the most important of which is the modernity of legal studies in the scope of environmental protection, as the world’s interest in it did not emerge seriously until after the middle of the twentieth century, in addition to strengthening the principle of criminal legality by clarifying the general elements of environmental crime and Which will contribute in an effective way to reducing violations of the rules of environmental legislation, and best but not least is knowing how the Algerian legislator faced those who threaten the environment.
