التخصص القضائي كضمانة للحد من جرائم حرق الغابات

Résumé: الملخص: إن ضرورة إرساء التخصص القضائي بالنظر إلى دور القضاء وفعاليته كآلية للتصدي للجرائم البيئية سواء على المستوى الوطني أو الدولي ، وخاصة جريمة حرق الغابات التي باتت تشكل حدثا ثابتا ومتكررا كل موسم، وحيث أن القضاء الدولي كان من بين الآليات التي أدت إلى تطوير القانون الدولي البيئي وبلورت العديد من المبادئ والتي تم تبنيها من خلال الاتفاقيات والمعاهدات الدولية المصادق عليها من طرف الدول لتصبح قوانين داخلية ملزمة للقضاء الوطني، غير أنه بحكم طبيعة الضرر البيئي والخصائص التي يتميز بها ومدى موائمة القواعد العامة للعمل القضائي بشكل عام أو الجزائي و موضوع الدراسة المتعلق بإحدى الجرائم البيئية والمتمثلة في حرق الغابات،بالإضافة إلى غياب جهاز قضائي نوعي ينظر في المسائل البيئية التي تعرض عليه من طرف الفواعل سواء وطنيا أو دوليا. Abstract: The need to establish judicial specialization in view of the role of the judiciary and its effectiveness as a mechanism to address environmental crimes, whether at the national or international level, especially the crime of burning forests, which has become a constant and recurring event every season, and since the international judiciary was among the mechanisms that led to the development of international environmental law and crystallized many principles, which were adopted through international conventions and treaties ratified by States to become binding internal laws for the national judiciary, but by nature Environmental damage and its characteristics and the extent of compatibility of the general rules of judicial work in general or penal and the subject of study related to one of the environmental crimes represented in forest burning, in addition to the absence of a qualitative judicial body that considers environmental issues that are presented to it by the actors, whether nationally or internationally.
