القواعد الإنسانية الدولية لحماية اللاجئين زمن النزاعات المسلحة

Résumé: إن ظاهرة اللجوء هي من أقدم الظواهر التي عرفتها البشرية، فما من حضارة إلا وعرف أهلها الهروب والانتقال من مكان لآخر طلبا للنجاة والابتعاد عن الأخطار التي تهددهم، وحاليا أصبحت تلك الظاهرة من أكثر المشكلات التي أرهقت ضمير الإنسانية، وازدادت حدتها مع الوقت، نظرا لما يتعرض له اللاجئين من اضطهاد وانتهاك لحقوقهم في بلدان اللجوء، وهو ما دفع المجتمع الدولي للبحث بجدية عن حلول حقيقة لهذه المعضلة، من خلال وضع قواعد قانونية تتكفل بوضع اللاجئين عبر مختلف الدول المستقبلة لهم. وتمثل ظاهرة اللاجئين أخطر تداعيات الحروب والصراعات في العالم، إذ تعاني مناطق ودول عديدة من هذه الظاهرة الإنسانية، ومما يزيد الوضع سوءا هو أن أغلب الدول المستضيفة للاجئين هي ذاتها دول نامية تعاني من مشاكل اقتصادية واجتماعية عديدة. ونظرا لتفاقم هذه المشكلة في الوقت الحالي وتزايد أعداد اللاجئين بسبب انتشار النزاعات المسلحة فإن ذلك استلزم ضرورة البحث في سبل كفالة حقوقهم والحماية القانونية الممنوحة لهم بموجب قواعد القانون الدولي الإنساني، لإلزام أطراف النزاع باحترام مركزهم القانوني أثناء النزاعات المسلحة، والتخفيف من الآثار المترتبة على هذه النزاعات. Abstract: The phenomenon of asylum is one of the oldest phenomena known to mankind. Refugees are persecuted and violated their rights in countries of asylum, which has prompted the international community to seriously seek real solutions to this dilemma, by establishing legal rules to ensure the status of refugees across the various receiving countries. The refugee phenomenon represents the most serious consequenceof wars and conflicts in the world, with many regions and states suffering from this humanitarian phenomenon, and the situation is made worse by the fact that most of the host states are themselves developing countries with many economic and social problems. In view of the current worsening of this problem and the increasing number of refugees due to the proliferation of armed conflicts, this necessitated the need to look into ways to ensure their rights and legal protection sought under the rules of international humanitarian law, in order to oblige the parties to the conflict to respect their legal status during the armed conflicts, mitigating the effects of these conflicts.
