الوضع تحت الحماية آلية مستحدثة للمحافظة على الثروة الغابية.

Résumé: مـلخـص تُعد الحماية الإدارية للثروات الغابية من أهم جوانب الحماية القانونية نظراً لأهميتها في الوقاية من التهديدات التي تواجه الغابات. هذه الحماية تتميز بطبيعتها الوقائية التي تهدف إلى المحافظة على الغابات ومنع تدهورها، من خلال تطبيق إجراءات وضوابط قانونية محددة. يشكل الضبط الإداري البيئي محوراً رئيسياً في هذه الحماية، إذ يتضمن مجموعة من الآليات والإجراءات التي تهدف إلى تنظيم الأنشطة البشرية وتقليل الأضرار التي قد تلحق بالبيئة الغابية. ومن بين الآليات المستحدثة في إطار القانون 23-21 المتعلق بالغابات والثروات الغابية تبرز آلية "الوضع تحت الحماية" كإجراء عملي مهم في مجال حماية الثروة الغابية، حيث تهدف هذه الآلية إلى تعزيز الحماية الإستباقية للمناطق الغابية المتدهورة من خلال فرض قيود صارمة على الأنشطة الغابية و ضغط الحيوانات التي قد تؤدي إلى زوال الثروة الغابية، كما تعززهذه الآلية من قدرة الإدارة على تنظيم الأنشطة الغابية بما يضمن تعافي الغابات المتدهورة وبالتالي المحافظة عليها. الكلمات المفتاحية: الوضع تحت الحماية؛ الضبط الإداري البيئي؛ تدهور الغابات. Abstract: The administrative protection of forest resources is considered one of the most important aspects of legal protection due to its significance in preventing threats to forests. This protection is characterized by its preventive nature, aiming to preserve forests and prevent their degradation through the application of specific legal procedures and regulations. Environmental administrative control plays a central role in this protection, encompassing a range of mechanisms and procedures designed to regulate human activities and minimize the damage that may be inflicted on the forest environment. Among the mechanisms introduced under Law No. 23-21 concerning forests and forest resources, the "Protection Status" mechanism stands out as a significant practical measure in the field of forest resource protection. This mechanism aims to enhance the proactive protection of degraded forest areas by imposing strict restrictions on forest activities and animal pressures that could lead to the depletion of forest resources. Additionally, this mechanism strengthens the administration's ability to regulate forest activities in a manner that ensures the recovery of degraded forests, thereby preserving them.
