الآليات القانونية لحماية العقار الثقافي في التشريع الجزائري

Résumé: يعتبر العقار الثقافي أحد أهم أوامر البعد الحضاري والتاريخي للمجتمعات والبشرية لكونه رصيد مشترك للإنسانية عامة، كما أنه تاريخ وحاضر بل مجد لساكنه الرقعة الجغرافية التي يوجد ضمن مجالها الاقليمي، وعليه فإن هذا النوع من التراث يجب صيانته وحمايته من خلال النصوص القانونية الناجعة، وذلك دون اهمال الدور التوعوي لوسائل الاعلام لا سيما الحديثة منها، ناهيك عن دور الجمعيات وفعاليات المجتمع المدني في نشر ثقافة الحفاظ على التراث الثقافي العقاري، لأن ذلك من شأنه الاسهام في تفعيل الحماية الازمة التي تتحقق بالشراكة والرهان على وعي المواطن بالدرجة الأولى دون اغفال الشق القانوني لا سيما من حيث ضرورة تماشيه وتناسبه مع المخاطر التي تتهدد العقار الثقافي في الجزائر. The cultural property is considered one of the most important orders of the cultural and historical dimension of societies and humanity because it is a common stock of humanity in general, and it is historical and present, but rather a glory for its inhabitants, the geographical area that is located within its regional domain, and therefore this type of heritage must be preserved and protected through effective legal texts, without neglecting The awareness-raising role of the media, especially the new ones, not to mention the role of associations and civil society actors in spreading the culture of preserving the cultural heritage of real estate, because this would contribute to activating the necessary protection that is achieved through partnership and betting on the awareness of the citizen in the first place without neglecting the legal aspect, especially from Where it is necessary to keep it in line with the risks threatening the cultural property in Algeria.
