مدى اعتبار الأسباب المفضية إلى انقضاء الدعوى العمومية في القانون الجزائري - الجريمة الوقتية والمستمرة نموذجا -

Résumé: ينطلق هذا المقال من التساؤل عن المدى الذي يمكن فيه اعتبار بعض الأسباب مفضية إلى انقضاء الدعوى العمومية في القانون الجزائري، وعن أهم التطبيقات في الجرائم والعقوبات. حيث انطلق البحث من مدخل مفاهيمي للدعوى العمومية تعريفا وخصائص ليبحث بعدها مدى اعتبار الأسباب العامة لانقضاء الدعوى العمومية من خلال بيان أثر الحكم البات على الجريمة الوقتية والمستمرة، وكذا العفو الشامل، الوفاة، التقادم، وأثر إلغاء قانون العقوبات، ثم تطرق لمدى اعتبار الأسباب الخاصة لانقضاء الدعوى فبين أثر سحب الشكوى وأثر الصلح. وخلص إلى نتائج منها اعتبار الصلح سببا من أسباب انقضاء الدعوى العمومية، متى كانت الجريمة بسيطة ولا تُشكل أي خطورة على المجتمع. Abstract This article dealt with the question to which extent some reasons can be considered for leading to the end of the public prosecution in Algerian law, and the most important implementations in crimes and penalties. The study started with conceptual approach to the public prosecution in order to define the characteristics of it by examining the effect of the ruling on temporary and continuous crime, as well as the pardon, death, Presumption of public proceedings and the effect of Abolition of the Penal law also, we discussed The case between the check out the complaint and the impact of reconciliation. The article concluded by the reconciliation which considered as one of the reasons for the expiry of the public prosecution, when the crime was simple and did not constitute any danger to society.
