ملامح الحِجاج الفقهي في التّراث العربيّ (ابن قيّم الجوزيّة أنموذجًا)

Résumé: ملخص البحث: تحظى الدراسات الحجاجية باهتمام كبير وإقبال واسع في المحافل العلمية والأكاديمية؛ وذلك لما تقدمه من كشوف وبيان لطرائق توظيف اللغة بغية تحقيق أهداف نفعية. وقد كثرت الدراسات في الحجاج وتنوعت ما بين كتب ومقالات، فدراستي ليست الدراسة الوحيدة في هذا الموضوع لكن ليس بين يدي الدارسين مدونة تهتم برصد خصوصية حجاج الفقهاء. وبناء على ذلك بدا من المهم الإقدام على خطوة أولى في تجسير هذه الفجوة المعرفية؛ لعلها تفتح بابًا لمزيد من الدراسات تستكمل البناء وتتلافى النقص، فكانت منهجية البحث مبنية كالآتي: مفهوم الحجاج لغة واصطلاحًا، ابن قيم الجوزية (معارفه اللغوية – البنية المنطقية للحجة عنده)، وذلك من خلال تطبيقات عملية تحليلية لنماذج من نصوص ابن القيم الحجاجية. وانسجامًا مع موضوع البحث اعتمدت مقاربة التحليل الحجاجي التي تتيح لي معرفة الخصائص اللغوية؛ بوصف الحجاجَ جزءًا لازمًا للغة، وجانبًا يسمح بمقاربة بنيتها الإبلاغية من منظور استعماليّ. الكلمات المفتاحية : الحجاج، الفقه، الفقهي، المنطق. Research Summary: The argumentation Studies are receiving significant attention in the scientific and academic communities, as they discover new methods of using the language to achieve valuable goals. Argumentation studies have increased and published in verity of formats including books and articles. My study is not the only one in this field, but there are no studies that focus on observing the uniqueness of the jurists' argumentation. As a result, it is important to take the first step in bridging this knowledge gap, so that it may pave the way for additional studies complementing the structure and addressing the deficiencies. The research methodology was based on the following: - The argumentation concept in language and terminology - Ibn Qayyim Al-Jawziyyah (his linguistic knowledge - The logical structure of his argumentation). - Through practical analytical applications of models from texts related to the argumentation of Ibn Qayyim. In keeping with the research subject, I have used analytical methodology that allowed me to learn the linguistic features considering the argument a necessary part of the language and whilst allowing it to approach its linguistic rhetoric structure from a usage perspective.
