استخدام القوة بين نصوص الميثاق وضوابط مسؤولية الحماية

Résumé: ملخص باللغة العربية: يعتبر مبدأ حظر استخدام القوة من المبادئ الراسخة في القانون الدولي بحيث اعتبرت قاعدة آمرة لا يجوز الإخلال بها وذلك بهدف حماية الجماعة الدولية من شتى الانتهاكات والتي تضاعفت عقب نهاية الحرب الباردة ،إذ عرفت تدخلات عدة في شؤون الدول و خروقات جسيمة لهذا المبدأ تحت ذريعة التدخل الإنساني الذي لطالما لم يكن مستساغ للدول التي اعتبرته انتهاكا لسيادتها مما أدى إلى تبني مبدأ مستجد (المسؤولية عن الحماية)للتوفيق بين حماية حقوق الإنسان والحفاظ على السيادة بالترخيص باستخدام القوة في ظروف محددة ووفق ضوابط ومعايير. ملخص باللغة الإنجليزية: The principle of the use of force is one of the established principles in international law ,as it was considered a peremptory rule that should not be violated ,with the aim of protecting the international community from various violations that have multiplied after the end of the Cold War, as it has known many interventions in the affaires of countries and grave breaches of this principle under the pretext of humanitarian intervention ,which was not always palatable to the counties that it considered violations of their sovereignty, which led to the adoption of principle of reconciling the protection of human rights with the preservation of sovereignty by authorizing the use of force in specific circumstances and in accordance with controls and standards.
