مقاربة تحليلية في رصد مضمون الكتلة الدستورية دراسة مقارنة ( فرنسا ، الجزائر )

Résumé: ملخص: إن منهج الفقه والقضاء الدستوري المقارن تجاوز الأطر الضيقة للنصوص الدستورية و أسس لتوظيف نصوص قانونية من خارج الوثيقة الدستورية أثناء رقابة دستورية القوانيين المخطر بها، الأمر الذي أدى في ظل هذا الوضع الجديد اتجاهه نحو توسيع الكتلة الدستورية بما يتماشى مع مقتضيات الشرعية الدستورية التي تسعى لحماية مجال الحقوق والحريات. غير أن منهج المجلس الدستوري الجزائري الذي بدأ مختلفا منذ البداية عن نموذجه التاريخي ( المجلس الدستوري الفرنسي ) الذي كان مقصورا على نصوص الوثيقة الدستورية،حيث عمد إلي تخطي نصوص الوثيقة الدستورية أثناء توسيع مرجعتيه الدستورية عن طريق فكرة الرابط الدستوري وبالتالي كرس توسيع الكتلة الدستورية بشكل غير مباشر . Abstract: The method of jurisprudence and the comparative constitutional judiciary exceeded the narrow frameworks of constitutional texts and the basis for the use of legal texts outside the constitutional document during the control of the constitutionality of the laws notifying, which led in light of this new situation towards the expansion of the constitutional bloc in line with the requirements of constitutional legitimacy, Rights and freedoms. However, the approach of the Algerian Constitutional Council, which began from the very beginning, differed from its historical model (the French Constitutional Council), which was limited to the provisions of the constitutional document. It bypassed the provisions of the constitutional document during the expansion of its constitutional references through the idea of constitutional linkage, As well as Expand the constitutional bloc indirectly.
