الوساطة الإلكترونية كوسيلة بديلة لحل منازعات التجارة الإلكترونية

Résumé: الملخص: تقوم التجارة الإلكترونية على السرعة في إبرام العقود لاعتمادها على البيئة الرقمية التي لا تشترط الحضور المادي لأطرافها، وهذا ما يتطلب وجود وسائل أو طرق تسوية منازعات إلكترونية تتماشى مع هذه البيئة، الشيء الذي لا يمكن للقضاء العادي بشكليته وتعقيد إجراءاته وبطئه توفيره للمتنازعين؛ مما جعل التشريعات الوضعية تفكر بجدية في وسائل إلكترونية لحل المنازعات ذات الطبيعة الإلكترونية بسرعة ومرونة وتحافظ في الوقت ذاته على العلاقات والروابط التي تجمع الأطراف. وتعد الوساطة الإلكترونية بمزاياها الكثيرة كالسرعة وبساطة إجراءاتها وآنيتها وسيلة ودية ملائمة لمنازعات التجارة الإلكترونية، وهي تكتسب صفة الإلكترونية من الطريقة التي تتم بها، حيث تتم بطريقة سمعية بصرية عبر شبكة الأنترنت، دون الحاجة إلى التقاء أطراف النزاع والوسيط في مكان معين. وتهدف هذه الدراسة إلى بيان مدى صلاحية الوساطة الإلكترونية لحل منازعات التجارة الإلكترونية. الكلمات المفتاحية: الوساطة، الوساطة الإلكترونية، منازعات، التجارة الإلكترونية. Electronic mediation as an alternative way to solve electronic commerce disputes Abstract: The electronic trade is based on the speed of the making of contacts .because it relies on the digital environment that doesn't require the physical Presence of their parties .this needs the existence of ways and means of resolving electronic disputes that go with this environment ,the thing that ordinary judiciary with its mechanism and slow ,complex procedures is not able to provide to its disputing parties .that made the législative status seriously considering electronic ways to resolve electronic disputes.The electronic mediation with its features such speed and simple procedures ,is considered as a suitable freindly ways to settle the electronic commerce .it took this feature from an audiovisual method without the need to the meeting of the disputing parties and the mediator at a certain place through the net web. This statement is intended to clarify the extent of the mediation validity in resolving the electronical commercial disputes.
