الدعوى الدستورية بين ترسيخ قواعد دولة القانون وضمان سير المؤسسات الدستورية (دراسة مقارنة)

Résumé: ملخص: إن الالتزام بأحكام الدستور، يحتاج إلى وجود رقابة على القواعد القانونية تضمن عدم خروجها على أحكامه وتراقب مدى اتفاقها معها، وهو ما يعرف بالرقابة على دستورية القوانين أو "القضاء الدستوري" أمام هذه التجربة الحديثة في مجال رقابة دستورية القوانين و من بينها التجربة الجزائرية، والتي تعتريها شوائب عدة في آليات تحريكها وآرائها وقراراتها، لذلك سنسلط الضوء في تقييمنا لهذه التجربة على النقائص وبعض المقترحات اللازمة من أجل ترقية عمل هذه الهيئة المخولة. Abstract Compliance with the provisions of the constitution requires the presence of oversight of the legal rules that ensure that they do not deviate from its provisions and monitor the extent of their agreement with them, which is known as oversight of the constitutionality of laws or “constitutional judiciary.” In the face of this modern experience in the field of constitutional control of laws, including the Algerian experience, which has several flaws, we will try to shed light in our assessment of this experience on the shortcomings and some necessary proposals .
