اذن القاضي في تعدد الزوجات في ظل سلطته الولائية

Résumé: نصت المادة الثامنة من قانون الأسرة الجزائري 05/02 على إمكانية التعدد في الزواج، الجمع بين أكثر من زوجة واحدة في عصمة الزوج في حدود الشريعة الإسلامية، ولا ينال الشخص-الزوج- الراغب في التعدد هذا المراد – المطلب – إلا بموافقة الزوجة التي في عصمته، وان يحصل على اذن وترخيص من رئيس المحكمة لمكان مسكن الزوجية. هذا، الأذن والترخيص يسمى بالسلطة الولائية للقاضي، لأجل اتخاذ تدابير معينة فوضها القانون في كثير من المسائل القانونية – عموما و في حالة لجوء الأزواج إلى تعدد الزوجات The Judge's Permission in Polygamy Under his State Authority Article 05/02 of the Algerian Family Law stipulates the possibility of polygamy and the union of more than one wife within the limits of the Islamic Law. The person willing to marry will not fulfill this wish except with the his wife's consent who is under his custody as well as obtaining an authorization from the president of the court for marital home place. This is called The State Authority of the Judge. This is done in order to take certain measures connected to different legal matters in case of polygamy
