آليات الرقابة الإدارية على مصادر التمويل الحزبي في التشريع الجزائري

Résumé: ملخص: تشكل الموارد المالية للأحزاب السياسية العمود الفقري لوجود الأحزاب وإستمراريتها، لذا عمد المشرع الجزائري إلى إخضاع هذه الأخيرة للرقابة الإدارية قصد ضبط النشاط المالي الحزبي . وعليه تهدف هذه الدراسة إلى بيان مصادر التمويل الحزبي في الجزائر وتوضيح مضمون الرقابة الإدارية على هذه المصادر وآلياتها قصد الوقوف على أوجه القصور التي تعتري ممارسة هذا النوع من الرقابة، وقد تمحورت إشكالية الدراسة حول ما إذا كانت الرقابة الإدارية على مصادر تمويل الحزبي هي رقابة كافية وفعالة لضبط النشاط المالي للأحزاب، وتوصلنا إلى نتائج أهمها أن الرقابة الإدارية غير كافية لحماية الحقوق المالية للأحزاب لأنها رقابة قد تنفذ من قبل هيئات غير مستقلة بالإضافة إلى أن بعض آليات الرقابة الإدارية تتيح للأحزاب السياسية التهرب من الإفصاح المالي عن مصادر تمويلها مما يفتح الباب للفساد المالي. Abstract: The financial resources of the political parties constitute the backbone of the existence and continuity of the parties, That is why the Algerian legislator imposed an Administrative control on it in order to control the party's financial activity. For this purpose, this study aims to determining the sources of partisan funding in the Algerian legislation, and to clarify the contents of administrative control over these sources and their mechanisms in order to identify the deficiencies in the practice of this type of control. Therefore, the problematic of the study revolved around whether the administrative control to track the sources of party financing is sufficient and effective control to adjust the financial activity of the parties, And we reached many results, the most important of them is that administrative control is not sufficient to protect the financial rights of parties because control may be implemented by non-independent bodies, in addition to that some administrative control mechanisms allow political parties to evade financial disclosure of their funding sources Which opens the door to financial corruption.
