مُحقّقُ المناطِ في المعاملات المالية المعاصرة

Résumé: إنّ تحقيقَ المناطِ مسلكٌ اجتهاديٌّ عظيمٌ، حيثُ إنّ تنزيلَ أحكامِ الشّرْعِ متوقّفٌ عليه، كما أنه يتّسم بالتعقيدِ والخفاء في كثير من المسائل، خاصة ما يتعلّق بالقضايا المعاصرةِ. ومِن ثَمَّ فإنّ إشكاليّة هذا البحثِ هي النّظرُ في حالِ مُحقّقِ المناطِ في القضايا المالية المعاصرة، أهو الفقيهُ بعد تصوّرِ المسألة تصوّرًا دقيقًا؛ إذ الأصل في الاجتهاد في استنباط الأحكامِ أنّه موكولٌ إلى الفقهاء المجتهدين؟ أم أنّ للخبير الذي له اطّلاعٌ على أحكامِ المعاملات الماليّة ومناطاتِها أن يُحقّق المناط؛ وذلك لتعقّد هذا الضّرب من القضايا وصعوبة تحقيق المناط فيه؟ وبعد إنْعامِ النّظرِ توصّل البحثُ إلى أنّ عمليّة تحقيق المناط إنّما هي من وظيفة الفقهاء المجتهدين دون غيرهم، مع وجوب أن يرجع الفقيه إلى الخبير في المسائل التي يتوقّف تحقيق المناط فيها على خبرة من الخبرات. وليس للخبير أن يُحقّق المناط بحال من الأحوال، وإنّما يقتصر دوره على تصوير المسائل وتوضيحها وبيانِ حقائقها. The realisation of the Manatt is a great diligent path since the transmission of the provisions of the Sharia is dependent on it. This paper tries to consider the case of the investigator of the Manatt in contemporary financial issues, is he the Al-Faqih, after visualising the issue accurately, since the basis for diligence in deriving rulings that are entrusted to diligent Faqihs? Or is it for the expert who has the full knowledge in the field to verify the criteria?. This research concluded that the process of verifying the Manatt is the job of the diligent Faqihs, with the obligation of the Al-Faqih to refer to the expert in matters in which the investigation of the criterion depends on experience. Besides, the expert does not have the right to investigate the issue under any circumstances, but his role is limited to clarifying the facts of the issues.
