العقوبات البديلة الرضائية في القانون الجزائري : الوضع تحت المراقبة الالكترونية أنموذجا

Résumé: ملخص: ألزمت مختلف التشريعات على ضرورة الحصول على موافقة المحكوم عليه عند تطبيق العقوبات البديلة ، حيث تعد فكرة الاعتداد برضا المحكوم عليه كألية لترشيد السياسة العقابية ، كون أن اشراك المحكوم عليه في تطبيقها يسهم في اصلاحه وتأهيله بشكل أفضل وبلوغ ما يسمى بالعدالة الرضائية التي تشمل كل مراحل الدعوى الجزائية وصولا الى مرحلة التنفيذ العقابي باستحداث عقوبات بديلة للسجن تنفذ بتعاون من المحكوم عليه ، وهذا ما كرسه المشرع الجزائري من خلال تبنيه لنظام الوضع تحت المراقبة الالكترونية بموجب القانون رقم 18-01 المتمم لقانون رقم 05-04 المتضمن قانون تنظيم السجون واعادة الادماج الاجتماعي للمحبوسين ، بحيث تعد الرضائية ركيزة هذا النظام لتطبيقه . abstract Various legislations impose the need to obtain the consent of the convict in order to apply alternatives sentences to him .because the idea of adopting the consent of the convict is a mechanism of rationalization of the sentence insofar as the involvement of the convict in his implementation contributes to reform and better reintegrating him into society and to achieve so-called consensual justice which includes all stages of criminal procedure up to the stage of punitive execution by introducing alternatives penalties to the custodial sentence to be implemented with the cooperation of the convict. This is established by the Algerian legislator through its adoption of the electronic surveillance provided for by law 18-01 supplementing law .05-04 on the law on the organization of prisons and the social reintegration of detains .this system based on the need for the convicted person’s consent in order to apply it.
