دور الاتفاقيات الدولية في حماية البيئة

Résumé: تنطلق هذه الدراسة من بيان ماهية القواعد والأحكام المعنية بحماية البيئة فى القانون الدولي بصفة عامة والقانون الدولي الإنساني خاصة للوقوف على مدى ما توفره هذه الأحكام وتلك القواعد من حماية للبيئة الطبيعية فى كافة صورها ومظاهرها خاصة فى أوقات الحروب والنزاعات المسلحة. إذ فى تلك الأوقات، كثيرا ما تتعرض البيئة الطبيعية بعناصرها المختلفة إلى الكثير من الاعتداءات والتجاوزات بما يحقق أضرارا بالغة تنعكس بدرجة أو بأخرى على كل الكائنات الحية بل وغير الحية التى تتأثر بكل التغيرات التى تنال من البيئة. وتكون هذه النزاعات أحد الأسباب الرئيسية التى تتسبب فى ضرر بالغ الأثر على مكونات البيئة الطبيعية.أي ما يسمى بانتهاكات لقواعد القانون الدولي الإنساني. This study begins by explaining the nature of the rules and provisions concerned with environmental protection in international law in general and international humanitarian law in particular, in order to determine the extent to which these provisions and rules provide protection for the natural environment in all its forms and manifestations, especially in times of war and armed conflict. In those times, the natural environment with its various elements is often exposed to many attacks and transgressions, causing severe damage that is reflected, to one degree or another, on all living and even non-living creatures that are affected by all the changes that affect the environment. These conflicts are one of the main causes that cause severe damage to the components of the natural environment. That is, what are called violations of the rules of international humanitarian law.
