اتفاقية حظر الأسلحة النووية لسنة 2017 القطعة المفقودة في النظام الدولي لنزع أسلحة الدمار الشامل

Résumé: في السنوات الأخيرة أضحى إحراز أي تقدم في ميدان نزع أسلحة الدمار الشامل أمر صعب المنال. لكن الذي حدث في 27 جويلية 2017 أحدث شرخا وقطيعة مع ممارسات الماضي. فلحد هذا التاريخ بقيتْ الأسلحة النووية آخر أسلحة الدمار الشامل لم يتم حظرها بالكامل. لقد استطاعت حفنة من الدول والمنظمات غير الحكومية أن تسوق مشروع اتفاقية يرمي لنزع الشرعية عن الأسلحة النووية، اصطفت حوله غالبية الدول الأطراف في منظمة الأمم المتحدة التي تمكنت من جعل المشروع حقيقة يُملأ به الفراغ القائم في القانون النووي الدولي. ومن ثَم، يهدف هذا البحث لتسليط الضوء على مسار المفاوضات لاتفاقية حظر الأسلحة النووية وردود أفعال القوى النووية حِيالها. ثم ينتقل لتمحيص ونقد محتواها، على أن ينتهي بإعطاء قراءة استشرافية لمستقبلها. In recent years, progress in the field of the elimination of weapons of mass destruction has become difficult to achieve. But what happened on 27 july 2018 has marked a break with the past. Until that date, nuclear weapons remained the last weapons of mass destruction not be completely banned. A handful of States and non-governmental organizations have been able to lead a draft convention delegitimizing nuclear weapons, which has convinced the majority of States Parties to the United Nations to support it and to make this project a piece to fill the gaps in international nuclear law. Therefore, this article aims to highlight the process of negotiation of the Nuclear Ban Treaty and the reactions of the nuclear powers to it. And then gives a critical analysis of its content, and end up bringing a prospective view of its future.
