معادلة اللاتوازن بين المورد الالكتروني والمستهلك في ظل القانون 18-05.

Résumé: : نظرا لخبرة المورد و احترافية باعتباره يمارس هذه المعاملات بصفة دائمة، و لأن المستهلك بشكل عام يفتقر للدارية و العلم في هذا المجال، وبالرغم من أن قانون المدني يحمي الجانب الضعيف في العقد (المدين) ويضع له ضمانات، كضمان العيوب الخفية و الحماية من الشروط التعسفية حسب المادة 05/11 القانون المدني، وبالرغم من نص القانون رقم 04/02 الذي يحدد قواعد مطبقة على ممارسات تجارية المعدل و المتمم للشروط التعسفية ،وبالرغم من إدراج المشرع في القانون المستهلك حق الضمان و الخدمة ما بعد البيع من المادة 4الى المادة 18 ،إلا أن القانون 09/03 المعدل و المتمم بالقانون 18/09 لم يتكلم عن حقوق المستهلك الالكتروني، أما قانون التجارة الالكتروني فقد نص عليها، و لكن تبقى الحماية ما زالت ضعيفة . إذن نحن أمام معادلة تجعلنا نبحث عن طريقة لجعل التوازن بين احترافية التاجر أو المورد الالكتروني و حقوق المستهلك الالكترونية .
