مدى اختصاص القضاء الإداري بالنظر في منازعات هيئات الضمان الاجتماعي

Résumé: يعد قطاع الضمان الإجتماعي نظام قانوني واجتماعي يهدف إلى تحقيق الأمن الإجتماعي والإقتصادي للأفراد، عند تعرضهم للمخاطر الإجتماعية والمهنية عن طريق إستخدم وسائل فنية خاصة بهذا النّظام. هذا وقد نتج عن تطبيق تشريعات الضمان الإجتماعي نزاعات معقدة وخصومات مختلفة من طرف المؤمنين الإجتماعيين أو أرباب العمل لاسيما الخواص منهم أمام هيئات الضمان الإجتماعي وأمام الجهات القضائية، حيث عني القانون رقم 08-08 المتعلق بالمنازعات في مجال الضمان الإجتماعي بكافة هذه المنازعات ؛ الأمر الذي يدفعنا لمعرفة مدى إختصاص القضاء الإداري في تسوية منازعات هيئات الضمان الإجتماعي خاصة أمام نذرة الدّراسات في هذا المجال. The social security sector is a legal and social system aimed at achieving social and economic security for individuals when exposed to social and professional risks by using technical means of this system. The application of social security legislation has resulted in complex disputes and various deductions by Social believers or employers, particularly those before the social security bodies and before the judiciary , Law 08-08 concerning disputes in the field of social security deals with all these disputes. This leads us to know the extent of the jurisdiction of the administrative judiciary in resolving the disputes of the social security bodies especially in light of the studies in this field.
