التدابير الوقائية من جرائم الفساد في التشريع الجزائري

Résumé: أصبح موضوع الوقاية من ظاهرة الفساد ومكافحتها محور اهتمام الدولة الجزائرية خصوصا بما يتعلق بالفساد في كل من القطاعين العام والخاص في التشريع الجزائري وذلك من خلال التعرف على مختلف التدابير التي وصفها المشرع صمن قانون الوقاية من الفساد ومكافحته فتحديد هذه التدابير تبين أنها وسيلة وأساس القضاء على الفساد، لذلك فقد حاولنا توضيح التدابير والاستراتيجيات التي وضعها المشرع للحد من هذه الظاهرة والتي تغلغت في أوساط المجتمع الجزائري فقسمنها الى تدابير وقائية في القطاع العام وأخرى بالقطاع الخاص إذ توضح أن تدابير القطاع العام متعلقة بالوظيفة والصفقات العمومية وأيضا التصريح بالممتلكات أما بالنسبة للقطاع الخاص فقد تطرقنا فيه لتدابير منع تبييض الأموال وفعالية مشاركة المجتمع المدني فهذه التدابير جاءت لمحاولة القضاء على الفساد في شتى القطاعات. The topic of preventing and combating the phenomenon of corruption has become the focus of the Algerian state's attention, especially with regard to corruption in both the public and private sectors in the Algerian legislation, through identifying the various measures described by the legislator within the law on preventing and combating corruption, identifying these measures turned out to be a means and the basis for the elimination of corruption, so we have tried to clarify the measures and strategies developed by the legislator to reduce this phenomenon, which has penetrated among Algerian society, so we have divided them into preventive measures in the public sector and others in the private sector, clarifying that the measures of the public sector related to employment and public transactions, as well as for the property sector In particular, we discussed measures to prevent money laundering and the effective participation of civil society, as these measures came to try to eliminate corruption in various sectors.
