سُبُل مكافحة الهجرة غير الشرعية عن طريق البحر في ظِل قُصور إتفاقية الأمم المتحدة لقانون البحار 1982

Résumé: إن الطرق أو الأساليب المستخدمة في الهجرة غير الشرعية عديدة و متشعبة، إلا أن ابرز الطرق التي تلجأإاليها شبكات التهريب، و أكثرها شيوعاً و استخداماً هو الطريق البحري، على إعتبار ان دول المقصد غالباً ما تكون موجودة على ضفاف أخرى من البحر، و رغم أن إتفاقية الأمم المتحدة لقانون البحار لسنة 1982 أوردت التدابير اللازمة لمكافحة الجرائم التي تقع في البحر و على رأسها جريمة القرصنة وتهريب المخدرات، إلا أنها أغفلت الإشارة إلى جريمة تهريب المهاجرين غير الشرعيين، و في ظل هذا القُصور تأتي هذه الدراسة للتعرف على التدابير أو الآليات التي يمكن إتخادها للتصدي للهجرة غير الشرعية عن طريق البحر.
