مبدأ الحيطة ودوره في حماية البيئة من المخاطر غير اليقينية للمشاريع الاستثمارية

Résumé: تحاول الدراسة الإجابة على بعض التساؤلات التي يطرحها موضوع الحيطة كأحد أهم النماذج المستحدثة التي تمثل الاستباقية في مواجهة المخاطر غير اليقينية الناجمة عن المشاريع الإنمائية، بداية من ظروف النشأة وغموض المفاهيم التي تحيط بالمبدأ وبعناصره، ومراحل الاعتراف به في القوانين الجزائرية وآليات إعماله وتفعيله، وصولا إلى تأثر قواعد الإثبات ونظام المسؤولية القانونية بعملية تطبيقه، ليأتي كل ذلك في مسعى واحد وهو البحث عن جدوى الحيطة البيئية في التعامل مع المخاطر غير اليقينية للمشاريع الاستثمارية تحقيقا للتنمية المستدامة. Abstract: The study attempted to answer some of the questions raised by the topic of prudence as one of the most important new models that represent proactiveness in confronting the uncertain risks resulting from development projects, starting from the circumstances of its emergence and the ambiguity of the concepts that surround it and its elements and the stages of its recognition in Algerian laws and the mechanisms of its implementation and activation, all the way to the impact of The rules of evidence and the legal liability system in the process of applying it, so that all of this comes in one effort, which is to search for the feasibility of environmental precaution in dealing with uncertain risks for investment projects to achieve sustainable development
