حدود سلطة الضبط الاداري في حماية البيئة في الجزائر

Résumé: إن موضوع حدود سلطة الضبط الإداري في حماية البيئة، يرتبط ارتباطا وثيقا بموضوع أهداف الضبط، وذلك لأن القضاء الاداري حينما يبسط سلطته على النشاط الضبطي يراعي غاية هذا النشاط ويلاحقه بالمسؤولية كلما خرج عن حدود الغاية المقررة له. ان ممارسة النشاط الضبطي قد يترتب عنه المساس بالحريات العامة للأفراد، وهذا لا يعني تقييدها. بل تخضع لمقتضيات المشروعية التي تحكم كافة القرارات الادارية وتضع عليها قيودا تحدد المدى الذي يجوز فيه المساس بها. The issue of the limits of administrative control in the protection of the environment is closely related to the object of the administrative control, because the administrative judiciary, when it simplifies its authority over the activity of control, takes into consideration the purpose of this activity and follows it with responsibility whenever it goes beyond the limits set for it. The exercise of disciplinary activity may result in prejudice to the general freedoms of individuals, and this does not mean restricting them. But subject to the requirements of legality, which governs all administrative decisions and impose restrictions on them to determine the extent to which they may be infringed.
