الأطفال اللاجئون العرب.. بين ضعف الالتزام الإنساني ونقص ضمانات الحماية Arab Refugee Children.. Between Weak Humanitarian Commitment And Lack Of Protection Guarantees

Résumé: يشكل الأطفال الفئة الأضعف والأكثر عرضة لمخاطر الحروب والنزاعات المسلحة واللجوء، فالنسبة الأكبر من اللاجئين في العالم هم من الأطفال إضافة الى النساء باعتبارهم من الفئات الهشة والضعيفة في المجتمع واللذين يكونون أكثر عرضة لانتهاك حقوقهم. وبالنظر الى أن الأغلبية الساحقة من الأطفال اللاجئين هم من المنطقة العربية (فلسطين، العراق، اليمن وحاليا أحداث الحراك العربي وما خلفته من موجات اللاجئين خاصة الأطفال الليبيون والسوريين منهم) فان العديد من الدول العربية تشهد هشاشة في تفعيل اتفاقية حقوق الطفل، كما أنها لم تنظم الى الاتفاقيات الدولية الخاصة باللاجئين، إضافة الى ضُعف التشريعات الوطنية وغياب الاتفاقيات الإقليمية الخاصة بحماية اللاجئين عموما والأطفال اللاجئين خصوصا. وتأتي هذه الدراسة ضمن هذا السياق، لتركز على المرجعية القانونية التي توفر ضمانات الحماية للأطفال اللاجئين، خاصة وأن هذه الفئة تشكل أكثر من 50%من العدد الإجمالي للاجئين، وأكثر من النصف هم في الدول العربية، وهو ما جعل الالتزام الأول هو التزام إنساني أخلاقي قبل أن يكون التزام قانوني اتفاقي. Children constitute the most vulnerable group and the most vulnerable to the risks of wars, armed conflicts and asylum. The largest proportion of refugees in the world are children in addition to women, as they are among the fragile and vulnerable groups in society who are more vulnerable to violations of their rights. Considering that the overwhelming majority of refugee children are from the Arab region (Palestine, Iraq, Yemen and currently the events of the Arab mouvement and the waves of refugees that they left behind, especially Libyan and Syrian children), many Arab countries are witnessing a fragility in activating the Convention on the Rights of the Child, and they have not regulated To the international conventions related to refugees, in addition to the weakness of national legislation and the absence of regional conventions for the protection of refugees in general and refugees children in particular. This study comes within this context, to focus on the legal reference that provides guarantees of protection for refuge children, especially since this group constitutes more than 50% of total number of refugees, and more than half are in the Arab countries, which made the first commitment a humanitarian and moral commitment before be a legal contractual obligation.
