التوقيع والتصديق الإلكترونيين و أمن المعلومات المتداولة الكترونيا(التجارة الالكترونية وحماية الخصوصية نموذجا)

Résumé: يواصل المشرع الجزائري بناء المنظومة القانونية للحكومة الالكترونية و ضمان تأمينها، لما تتضمنه من معلومات متداولة إلكترونيا كانت أولى خطوات هذا البناء صدور القانون 15/04 المحدد للقواعد العامة للتوقيع والتصديق الإلكترونيين. ومن بين ما أقره هذا القانون كفالة حماية قانونية للتوقيع الإلكتروني إنقسمت ما بين الحماية التقنية عن طريق آلية التشفير، والحماية المدنية والجزائية ضد أشكال الاعتداءات التي قد تطاله.وقد أثرت الصلة الوثيقة بين التوقيع الالكتروني وتطبيقاته في مجالات التجارة الإلكترونية وحماية حقوق المستهلك والحق في السرية والخصوصية ، في أن النصوص التي تحمي هذه المصالح قد تتضمن بعض صور حماية التوقيع الإلكتروني أو على الأقل تكملة الحماية المقررة له خصوصا بعد صدور قانون التجارة الإلكترونية 18/05 وقانون حماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطبع الشخصي 18/07 . The Algerian legislator continues to build the legal system for e-government whose first step was the promulgation of Law 15/04 that outlines the general rules for electronic signature and ratification. Among those approved by this law is ensuring legal protection for the electronic signature divided between technical protection through the encryption mechanism, and civil and criminal protection against the forms of attacks that may affect it. The close relationship between the electronic signature and its applications in the areas of electronic commerce and the protection of consumer rights and the right to confidentiality and privacy has influenced that the texts that protect these interests may include some forms of electronic signature protection or at least complement the protection prescribed to it, especially after the issuance of the electronic commerce law 18/05 The Law on the Protection of Natural Persons in the Field of Personal Data Processing 18/07 .
