حق زيارة الطفل المحضون في ضوء القانونين الجزائري والفرنسي
Résumé: ملخص باللغة العربية: حينما يحكم القاضي الجزائري بإسناد الحضانة لأحد الزوجين يقضي بقوة القانون بحق الزيارة للزوج الآخر طبقا لمفتضيات قانون الأسرة. وبالمقابل، عند انفصال أبوي الطفل يمنح القاضي الفرنسي لأحد الأبوين السلطة الأبوية ويمنح للآخر حق الزيارة عندما يطلبه طبقا لمقتضيات القانون المدني . غير أن هذا الحق يثير عدد من الاشكلات الموضوعية والاجرائية تختلف باختلاف القانون المنظم لأحكامه. Abstract: When the Algerian judge grants custody to one of the spouses, he grants the other spouse the right of visit in accordance with the requirements of the family law. On the other hand, when the child's parents separate, the French judge grants parental authority to one of the parents and grants the other the right to visit when he requests it according to the requirements of civil law. However, this right raises a number of substantive and procedural problems that differ according to the law regulating its provisions.
