الضمانات القانونية والقضائية للناقل البحري للبضائع الرئيسي (دعاوى رجوع ضد الناقل البحري الفعلي المسؤول عن الاضرار اللاحقة بالبضائع)

Résumé: وضع المشرع الجزائري في القانون البحري آليات لحماية ذمة الناقل البحري للبضائع الرئيسي بعد تنفيد التزامه بالتعويض عن الأضرار اللاحقة بالبضائع محل هذا العقد لقيام مسؤوليته التعاقدية تجاه صاحب الحق في البضاعة، كونه غير مسؤول فعليا عن هذه الخسائر المادية الواقعة في مرحلة من مراحل الرحلة البحرية الذي التزم بتنفيذها جزئيا ناقل بحري فعلي اخر، وباستعمال حقه في رفع دعوى من دعاوى الرجوع ضده بحسب طبيعة العقد المبرم مع هذا الاخير من عقد النقل البحري للبضائع المتتابع احادي الوساطة الى عقود خدمات المقاولات المينائية، وذلك بعد احترامه لشروط قبولها واتباعه لإجراءات القانونية وبرفعها امام الجهة القضائية المختصة. The Algerian legislator has put in the maritime law mechanisms to protect the liability of the shipping carrier of the main goods after executing his obligation to compensate for the damages caused to the goods subject of this contract for the establishment of his contractual responsibility towards the owner of the right to the goods, as he is not actually responsible for these material losses occurring at a stage of the sea voyage, which he committed By partially implementing another actual shipping carrier, and by using his right to file a claim of recourse against him according to the nature of the contract concluded with the latter from the maritime transport contract of unilateral successive goods to the port contracting services contracts, after respecting the terms of their acceptance and following the legal procedures and by filing them before the competent judicial authority
