صور الحماية الجزائية الموضوعية لذوي الإحتياجات الخاصة في التشريع الجزائري

Résumé: الملخص: ينصب موضوع هذه الدراسة حول" صور الحماية الجزائية لذوي الإحتياجات الخاصة في التشريع الجزائري" حيث أضفى المشرع الجزائري حماية جزائية خاصة من خلال التنصيص على جرائم معينة( جريمة التمييز، جريمة التعريض للخطر ، التحرش الجنسي ...) تطال هذه الفئة من المجتمع كونها الأكثر عرضة للجريمة يستغل الجاني ضعفها وعدم قدرتها الدفاع عن نفسها فما أصابها كان مقدرا سواء منذ ولادتهم أو بعد ذلك بإعاقة قللت من قدرتهم على القيام بأدوارهم الإجتماعية على الوجه الأكمل مثل الأشخاص العاديين، الشئ الذي يجعل منهم هدفا سهلا للمجرمين . فكان من الضروري على المشرع تشديد العقوبة في الجرائم التي يكون المجني عليه فيها شخصا من ذوي الإحتياجات الخاصة كظرف مشدد ، وهو ما سوف نبينه بالشرح والتحليل من خلال نصوص قانون العقوبات والقوانين الخاصة ومدى نجاعتها في حماية هذه الفئة المستضعفة من المجتمع من الإعتداء . Abstract: The topic of this study focuses on “ Penal protection for people with special needs in Algerian legislation ” where the Algerian legislator granted special penal protection by specifying certain crimes (crime of discrimination, crime of endangerment, sexual harassment...) that affect this group of society as it is the most vulnerable. For the crime, the offender exploits her weakness and her inability to defend herself. What happened to her was predestined, whether since their birth or after that, with a disability that reduced their ability to perform their social roles to the fullest extent like ordinary people, which makes them an easy target for criminals . It was necessary for the legislator to tighten the penalty in crimes in which the victim is a person with special needs as an aggravating circumstance, which we will explain with explanation and analysis through the provisions of the Penal Code and special laws and the extent of their effectiveness in protecting this vulnerable group of society from abuse .
