الحماية الجنائية لحق الطفل في السلامة البدنية داخل المؤسسة التعليمية

Résumé: الملخص: في إطار تطور فلسفة حقوق الطفل في الجزائر وفي ظل الاهتمام العالمي الواسع والمتزايد؛ تسعى الجزائر جاهدة من أجل تكريس حق الأطفال في التمدرس، والموازنة بين هذا الحق وتجريم كل أشكال العنف البدني ضد الأطفال حفاظا على صحتهم وسلامتهم البدنية حتى ولو اتخذ هذا العنف شكلا من أشكال التأديب داخل المؤسسة التعليمية. نحاول من خلال هذه الورقة البحثية أن نسلط الضوء على مجمل القواعد التي أقرها المشرع الجزائري من أجل حماية الطفل داخل محيطه المدرسي من كافة أشكال العنف والإيذاء البدني. Abstract: Within the framework of the development of the philosophy of the Child rights in Algeria and in light of the widespread and growing international interest; Algeria is striving to enshrine the right of children to school, the balance between this right and the criminalization of all forms of physical violence against children in order to preserve their health and physical integrity, even if this violence took some form of discipline within the educational institution. Through this research paper, we try to shed light on the overall rules approved by the Algerian legislator in order to protect the child within his school environment from all forms of violence and physical abuse.
