_العدالة فضيلة للمؤسسات السياسية على قاعدة اجتماعية _ عند"جون راولز"

Résumé: السياقات العالمية الجديدة تطرح مفهوم مغاير للعدالة باعتبارها مفهوما كلاسيكي ما دفع الفلاسفة و المنشغلين بالحقول المجاورة كعلم الاجتماع و علم السياسة غلى توضيح و كشف معنى العدالة و التباساتها، داخل نقاش تباينت فيه الرؤى حول قضايا العدالة .قد ظهر في خضم هده النقاشات الفيلسوف و المفكر الأمريكي جون راولز في كتابه نظرية العدالة قائلا :"العدالة فضيلة المؤسسات الاجتماعية كالحقيقة بالنسبة لأنساق الفكر". و نظريته جاءت متميزة كجزء من نقد الليبرالية الغربية و العودة إلى العدالة كأفق سياسي و حضاري و إيطيقي و ليست كفكرة طوباوية او ثيولوجية كما وجدت عند ارسطو أو الواجبية عند كانط، ومن هنا يميز "جون راولز" مفهوم العدالة عن تصورات العدالة: إن الناس الذين لهم تصورات مختلفة عن العدالة يمكنهم، مع ذلك أن يتفقوا حول المؤسسات العادلة، وهي تلك التي لا تقيم أي تميز تعسفي بين الأشخاص في تثبيت الحقوق والواجبات الأساسية وبالتالي تقيم توازنا ملائما بين المطالب المتنافسة بصدد امتيازات الحياة الاجتماعية The new global contexts present a different concept of justice, considered as a classic concept, which led philosophers and practitioners in neighboring fields such as sociology and political science to clarify and reveal the meaning of justice and its contradictions, in a debate where visions differed on the issues of justice. In the midst of these debates the American philosopher and thinker “John Rawls” in his book “The Theory of Justice” tells: “Justice is the virtue of social institutions as is the truth for the systems of thought”. His theory was distinguished as a part of the critique of Western liberalism and a return to justice as a political, cultural, and ideological horizon, not as a utopian or theological idea as found in the works Aristotle’s works or in Kant’s concept of duties. Accordingly, John Rawls distinguishes between the concept of justice and the perceptions of justice: People who have different perceptions of justice can, however, agree on fair institutions, which do not establish any arbitrary distinction between people in the consolidation of basic rights and duties and thus establish an appropriate balance between competing demands for the privileges of sociologic life.
