مبدأ سلطان الإرادة في وقف الخصومة المدنية

Résumé: الملخص: الخصومة القضائية هي ذلك الأثر المباشر الناتج عن استعمال الفرد للدعوى التي أقرها الدستور أين تم تأصيلها في حق اللجوء إلى القضاء ، و التي ترتكز على المطالبة القضائية حيث تتجسد الخصومة في جملة من الإجراءات والأصل فيها إنتهائها بحكم فاصل في موضوعها، ولكن خروجا عن القاعدة قد تعترض الخصومة أثناء سيرها مستجدات تحول دون الفصل فيها .ومنه كان لزاما على المشرع التدخل لمعالجة الأوضاع المستجدة فيما عبر عنه بالعوارض ، ولقد اقتصرت الدراسة على عارض الوقف الإتفاقي كون الاتجاه الحديث يفعل مبدأ سلطان الإرادة في وقف الخصومة المدنية . الكلمات المفتاحية: العوارض، سلطان الإرادة، الوقف الاتفاقي. Abstract : Judicial dispute is the direct effect of the individual's use of the case, which was adopted by the Constitution, where it was rooted in the right of recourse to the judiciary, which is based on the judicial claim where the dispute is embodied in a number of specific procedures, which a verdict is issued and this is the generalrule. But as an exception of this rule the dispute may issued and not solved so that the legislator has intervened to treat this problem known as issues so the study shed light on conventional suspension ،indeed the modern doctrine recognize the rule of voluntary convention to suspend the civil litigation.
