حق المستهلك الالكتروني في الرجوع عن التعاقد بين قصور النص القانوني وواقع الممارسة العملية في التشريع الجزائري

Résumé: يعد عقد الاستهلاك الالكتروني من اكثر العقود شيوعا في البيئة الرقمية لذلك اقر المشرع الجزائري حق العدول كآلية لضمان حماية المستهلك في البيئة الرقمية ، وهو و إن كان خروجا عن مبدأ القوة الملزمة للعقد إلا أن الطبيعة الخاصة للتعاقد الالكتروني و المركز الضعيف للمستهلك الالكتروني يخلقان مبررا لهذا الخروج ليكون بمثابة حق امتياز يمنحه المشرع للمستهلك في عقود الاستهلاك الالكترونية بهدف إعادة التوازن المفقود في العلاقة العقدية في مجال التجارة الالكترونية . The electronic consumption contract is one of the most common contracts in the digital environment, so the Algerian legislator recognized the right to reinstate as a mechanism to ensure the protection of the consumer in the digital environment, which is a departure from the principle of binding power of the contract, but the special nature of the electronic contract and the weak status of the consumer E-mail creates a justification for this exit as a concession granted by the legislator to the consumer in electronic consumption contracts in order to restore the lost balance in the contractual relationship in the field of electronic commerce.
