منازاعات رخصة البناء في القانون الجزائر

Résumé: لقد أولى المشرع الجزائري في السنوات الأخيرة اهتماما كبيرا للمجال العمراني ومشاكله الذي يعد مجالا حساسا ، لذا ربط حق البناء بضرورة الحصول على ترخيص إداري مسبق من الإدارة المختصة قانونا وفق الشكل ، والشروط ، والإجراءات المحددة سلفا بأحكام تشريعية وتنظيمية وهو ما يعرف بالنظام القانوني لرخصة البناء . وبما أن رخصة البناء تعتبر قرارا إداريا صادرا عن سلطة إدارية عامة ، الأمر الذي يجعلها تخضع لرقابة القاضي الإداري في حال حدوث نزاع بين الإدارة والأفراد حول مشروعية قرار الترخيص بالبناء، كما تمتد رقابة القضاء في حال إخلال الأفراد بالتزاماتهم القانونية عند التنفيذ ، سواء إلى القضاء المدني أو الجزائي على ألا يكون القرار المتضمن الترخيص بالبناء محل طعن . الأمر الذي يتعدد معه الاختصاص القضائي الناظر في منازعات رخصة البناء ، ولكن هذا لا يمنع من أن تتخذ الإدارة عقوبات إدارية في مواجهة المخالفين لأحكام قانون التهيئة والتعمير عند القيام بأعمال البناء ، ذلك كله بعد اتخاذ التدابير الوقائية للحد من المخالفات قبل استفحالها . بالغة الفرنسية In recetent teaes , The Algerian has paid attention to the urban area and its cases , with is considered a sensitive area , For that linking the right of construction to the need to obtain a prior administrative license from the competent administration legally according to the from and condition and procedures predetermind by legislative and regulatory provisions , This is known as the legal system of building permit , Since the building permit is an administratim decision issued by public administrative authority , it will be a subject to the administrative judge’s control in the event of a dispute between the administration and the individuals about the legality oh the decision to authorize the building .
