المسؤولية المدنية لمنتجي الدواء حول الأضرار الناجمة عن الدواء المعيب

Résumé: يخضع الدواء عند صناعته و توزيعه لإجراءات دقيقة تميزه عن باقي المنتجات الصناعية، و يخضع لرقابة صارمة بُغية توفير الحماية اللازمة لمستهلكيه و ذلك لجهل المستهلك بخطورته. و قد ينتج عن هذه المخاطر أضرارًا تصيب مستهلك المنتجات الدوائية، و هو ما يقتضي ضرورة جبر الضرر الذي لحق به، و لا يتأتَّى ذلك إلاّ من خلال إقرار المسؤولية المدنية لمُنتِج المنتجات الدوائية المَعيبة. تتعرض هذه الدراسة لتحديد نطاق المسؤولية المدنية عن الدواء المَعيب عبر تحديد الالتزامات المفروضة على مُنتج الدواء، تحديد الضرر و العلاقة السببية بينه و بين المنتِج وصولًا إلى تقدير التعويض المناسب. When it is produced and distributed, the medicinal product is subject to strict control procedures, which distinguish it from other manufactured products, in order to guarantee maximum protection to consumers who are unaware of its dangerousness. These dangerousness can cause damage to consumers of medicines, which requires reparation, and this can only be done by establishing civil liability without fault of producers of defective medicines. This study determines the extent of civil liability of the damaged medicinal product, by determining the obligations of medicines producers, the damage and the causal relationship between the damage and the producer, arriving at the estimate of the appropriate compensation.
