فاعلية الوسائل الإدارية في تحقيق الحماية الوقائية للساحل في الجزائر

Résumé: تنصب هذه الدراسة حول فاعلية الوسائل الإدارية في تحقيق الحماية الوقائية للساحل في الجزائر حيث أقر المشرع الجزائري ضمن القانون 02-02 المتعلق بحماية الساحل و تثمينه مجموعة من الأدوات القانونية المنظمة للبيئة الساحلية محاولا تحقيق الحماية و التثمين لهذا الفضاء الحساس من خلال استعمال آليات قانونية إدارية و المتمثلة في وسائل الضبط الإدارية التي تمارس من خلالها الإدارة رقابتها القبلية على الأنشطة فلها استعمال أسلوب الحضر أو الإلزام أو الترخيص وكما يمكنها استعمال نظام التقارير و الدراسات البيئية بالإضافة إلى مخططات حماية البيئة الساحلية التي بموجبها خول القانون للإدارة فرض رقابتها القبلية من خلال صيانة و حماية المناطق الساحلية قبل وقوع الضرر توصلت في هذه الدراسة إلى أن نجاعة الوسائل الإدارية في تحقيق الحماية الفعلية للساحل تكمن من خلال استعمال لسلطات الضبط الإداري آليات وقائية قبلية في سبيل حماية البيئة الساحلية من كل خطر يهددها. This study focuses on the effectiveness of administrative means in achieving preventive protection of the coast in Algeria, where the Algerian legislator approved within Law 02-02 related to the protection and valuation of the coast a set of legal tools regulating the coastal environment trying to achieve protection and valuation of this sensitive space through the use of administrative legal mechanisms and Represented in the means of administrative control through which the administration exercises its tribal control over the activities, it has the right to use the method of prohibition, obligation or licensing, and it can also use the system of environmental reports and studies in addition to the coastal environment protection schemes according to which the law authorizes the administration to impose its tribal control through the maintenance and protection of areas In this study, I found that the effectiveness of administrative means in achieving effective protection of the coast lies through the use of tribal preventive mechanisms by the administrative control authorities in order to protect the coastal environment from every threat that threatens it.
