المسؤولية التقصيرية والمسؤولية العقدية: تمييز نحو زوال؟

Résumé: يُنسب التمييز بين المسؤولية التقصيرية والمسؤولية العقدية إلى القانون الفرنسي القديم، وقد انتقل إلى قانون نابليون (1804)، وتأثرت به التشريعات العربية ومنها القانون المدني الجزائري، ويظهر أنه لا يقوم على أساس قانوني متين، مما جعله عُرضة للجدل الفقهي منذ زمن بعيد، لا سيما وأن هناك بوادر في القانون الوضعي المعاصر تؤيّد تجاوزه نحو بناء مسؤولية قانونية موحّدة في بعض المجالات، وهو ما تؤكّده الدراسات الحديثة، وتسعى إليه المشاريع الفقهية الأوروبية الجماعية بدرجات متفاوتة، مما فتح الباب واسعا لاقتراح بدائل حديثة تغني عن هذا التمييز الكلاسيكي. The distinction between tort liability and contractual liability is attributed to the old French law, and it was passed on to the Law of Napoleon (1804), influenced by Arab legislation, including the Algerian civil law, and shows that it is not based on a solid legal basis, which made it subject to doctrine controversy a long time ago, no In particular, there are signs in contemporary positive law that support its transcendence towards building a unified legal liability , as confirmed by recent studies, and sought by collective European doctrine projects to varying degrees, opening the door wide to proposing modern alternatives that would replace this classic distinction.
