الاختلاف في التكييف الفقهي للقضايا المعاصرة – دراسة تحليلية مقارنة

Résumé: تبعا لاستمرارية الحياة وتجددها، عَرفتْ وتعرِفُ الأمةُ الإسلاميةُ وقائعَ ومستجداتٍ لا متناهيةٍ على كافةِ المستوياتِ والأَصعِدةِ، فدعتِ الضرورةُ أهلَ الِاختِصاصِ الِاجْتهادَ لإيجادِ أحكامٍ شرعيةٍ لهذه النوازل. ومن الطبيعيِّ أنَّ استنباطَ الأحكامِ له قواعدٌ وضوابطٌ تحْكُمهُ؛ فليس بإمكان الناظر في النازلة استنباط حكم لها ما لم يحسن تصويرها وتكييفها فقهيا. ولهذا فإن التكييف الفقهي الذي هو إلحاق المستجدة بأصل فقهي لتأخذ حكم هذا الأصل ضرورة شرعية ملحة. إلاّ أنّ التكييف الفقهي طاله الاختلاف كغيره من أبواب الفقه لعدة أسباب ودوافع. وهذا ما حفَّزني لاختيار هذا الموضوع للتعريف بالاختلاف في التكييف الفقهي للقضايا المعاصرة وتطبيقاته. فأسأل الله التوفيق والسداد في إنجاز هذا العمل.Differencies in "Fikh" Adaptation to Nowadaysaffairs Following the continuity of lif, the Islamic nation knew and stillknows a greatnumber of new facts on all levels and sides, necessitycalled the specialists in jurisprudence to find out legallaws to these new facts. Naturally the deduction of these laws should have special rules. The savant can't find out a law to a nowadays problem if he doesn't imagine it and adapt it to "Fikh" as well as possible. Thus, the "Fikh" adaptation which is linking the new fact to a "Fikh" root in order to take its law is a very legal necessity and obligation. But as any other subjects the "Fikh" adaptation knows also many differences because of numerous causes. This has encouraged me to choose this subject in order to clarify the differences in "Fikh" adaptation to recent facts and its applications.
