أثر الفقه الاسلامي في الصناعة التقنينية لأحكام الأسرة في التشريع الجزائري ـ أحكام الخلع نموذجا ـ

Résumé: تتجلى أهمية هذه الدراسة في إبراز مكانة الفقه الإسلامي في المنظومة القانونية الجزائرية وبالأخص ما تعلق بشؤون الأسرة،حيث يتمحور إشكال الدراسة حول مدى تأثر المشرع الجزائري بأحكام الفقه الإسلامي في تقنينه وتنظيمه لأحكام الأسرة من خلال التطرق لنموذج الخلع كآلية لفك الرابطة الزوجية،وذلك وفق المنهج الوصفي والتحليلي والمقارن،وقد خلصنا في النهاية إلى أن الخلع نظام تفردت به الشريعة الإسلامية وأخذه عنها المشرع الجزائري حيث نظم الأحكام المتعلقة به وفق ما اقره فقهاء الإسلام . Abstract: The importance of this study is evident in highlighting the position of Islamic jurisprudence in the Algerian legal system, especially in relation to family affairs, where the problem of the study revolves around the extent to which the Algerian legislator is affected by the provisions of Islamic jurisprudence in its codification and organization of family rulings by addressing the model of khul` as a mechanism for breaking the marital bond, according to the descriptive approach And analytical and comparative, and we concluded in the end that khula is a system unique to Islamic law and taken from it by the Algerian legislator, where he regulated the provisions related to it according to what was approved by the Islamic jurists. .
