آثار العرف الدولي على أحكام القضاء الدولي الجنائي و القانون الدولي الإنساني

Résumé: وجد القضاء الدولي الجنائي من اجل إصدار أحكام قضائية ضد الأشخاص المتهمين بارتكاب جرائم دولية ، نتج عنها الكثير من الانتهاكات للقوانين الدولية، وخاصة القانون الدولي الإنساني ( اتفاقيات جنيف الأربع 1949 ، البروتوكولين الإضافيين 1977) ،وتطبيق هذه الأحكام القضائية الدولية الجنائية يتحكم فيها عدة عوامل ، منها العرف الدولي ، الذي يعتبر له تأثير ايجابي وسلبي على تطبيق الأحكام القضائية الدولية الجنائية ، وتطبيق القانون الدولي الإنساني،ذلك نتيجة لعدم توفر أجهزة دولية تسهر على متابعة تنفيذ هذه الأحكام ،وبما أن العرف الدولي عبارة عن عادات تعارفت عليها الدول من قبل ، فإن ذلك يعتبر إشكال لان الزمن في تطور وما اتفقت الدول قديما على اعتباره عرف دولي ، قد يكون اليوم يشكل تهديدا أو خطرا على مصالحها مثل حماية اللاجئين ، موجود قديما و الآن الكثير من الدول تعتبرهم أزمة لبلادهم مثل ما اعتبرته مؤخرا فرنسا...The international criminal justice system has been established to prosecute individuals accused of international crimes, resulting in many violations of international law, particularly international humanitarian law (the Fourth Geneva Conventions, 1949 Additional Protocols 1977).
