الحماية القانونية لحق العمل في الفقه والقانون

Résumé: تهدف الدراسة إلى التعريف بحق الإنسان في العمل، هذا الأخير الذي يعتبر من الحقوق الأساسية التي تكفل له العيش الكريم، فلقد نصت عليه الاتفاقيات الدولية والدساتير والقوانين الوطنية، من خلال إقرارها للآليات القانونية اللازمة لتنفيذه ومراقبة تطبيقه، وكذا توفير حماية القانونية اللازمة لتمكين الإنسان من ممارسة حقه في العمل. وفي هذا الاطار فقد سعت التشريعات الوطنية للنص على حق العمل على عدة مستويات بغرض إعطاء أساس قوى لهذا الحق يدعم تطبيقه، الي جانب إقرار آليات قانونبة من شأنها ضمان تمتع الإنسان بحقه في العمل وإنشاء صور للرقابة على تنفيذه. Abstract The study aimed to introduce the human right to work, which is considered one of the basic rights that guarantee a decent living. It has been stipulated in international agreements, constitutions and laws, and finds its basis in various divine laws. Legal mechanisms have been developed to implement and monitor its application and provide the necessary legal protection to enable humans to exercise this right. This is in national legislation, international agreements, covenants and covenants. The study reached several results, including that countries sought, through national legislation, to stipulate the right to work at several levels, starting with constitutions, laws, and regulations, in order to create a strong basis for this right, in addition to stipulating several texts that support its application through mechanisms to ensure that people enjoy their right to work and create images.
