الهبة الواردة على العقار في التشريع الجزائري

Résumé: الهبة الواقعة على العقار هي تمليك بلا عوض، ويجوز أن يشترط الواهب على الموهوب له إنجاز التزام يتوقف على تمامها، من خصائصها أنها عقد مسمى، ملزمة لجانب واحد، وهي من التصرفات التبرعية التي تتم ما بين الأحياء، تصح بشروط عامة تتمثل في التراضي والمحل والسبب وشروط خاصة هي الشكلية والحيازة. ولأن هذا العقد يقع على عقار لابد من مراعاة أحكام التوثيق بإتباع الشكل الرسمي وإجراءات التسجيل والشهر العقاري، وبتخلف أحد هذه الشروط تكون الهبة باطلة، فلا ترتب آثارها سواء فيما بين المتعاقدين أو بالنسبة للغير. وإذا تمت صحيحة تنشأ إلتزامات في ذمة الواهب والموهوب له، ومع ذلك يمكن لعقد الهبة أن يثير عدة إشكالات ومنازعات أغلبها تتمحور في دعوى الرجوع والإبطال. The gift on the real estate is ownership without compensation، and it is permissible for the donor to stipulate that the gifted person performs a commitment that depends on its completeness. Especially it is formalism and possession. And because this contract is located on a real estate, the provisions of documentation must be observed by following the official form, registration procedures and real estate registration، and if one of these conditions fails، the donation is void, so its effects are not arranged either between the contracting parties or for others. If it is correct, obligations arise for the donor and the gifted to him. Nevertheless, the donation contract can raise several problems and disputes, most of which revolve around the case of recourse and annulment.
