طبيعة العلاقة بين المؤسسات الناشئة و شركة المساهمة البسيطة

Résumé: قام المشرع الجزائري بإدراج شركة المساهمة البسيطة في القانون التجاري و تمييزها عن غيرها من أنواع الشركات الآخر، بل خصصها فقط للمشاريع و الافكار الابتكارية فقط و هذا عندما حصر إنشاء شركة المساهمة البسيطة من طرف الشركات الحاصلة على علامة "مؤسسة ناشئة" فقط دون غيرها. وكان هذا التعديل في إطار التطور المتسارع للاقتصاد العالمي، الناتج عن عولمة الاقتصاد وأساليبه وأيضا من أجل تبسيط إنشاء الشركات التجارية، بغرض متكين الشباب حاملي المشاريع من تأسيس شركاتهم الخاصة. و ايضا في إطار ترقية المؤسسات الناشئة، و لكون هذا النوع من الشركات من شأنه إعطاء دفع جديد للمؤسسات الناشئة، ورفع العوائق التي تواجه عملية تمويلها وكذا تكييف تنظيمها وسيرها. The Algerian legislator included the simple joint-stock company in the commercial law and distinguished it from other types of other companies. Rather, he allocated it only to innovative projects and ideas only, and this was when he limited the establishment of the simple joint-stock company by companies that obtained the “start-up” label only and not others. This amendment was within the framework of the rapid development of the global economy, resulting from the globalization of the economy and its methods, and also in order to simplify the establishment of commercial companies, with the aim of enabling young entrepreneurs to establish their own companies. And also within the framework of upgrading emerging enterprises, and because this type of company would give new impetus to emerging enterprises, and raise the obstacles facing their financing process, as well as adapting their organization and functionig.
