Résumé: The peaceful use of nuclear energy by any country in International Law based on the right of economical and political self- determination, and it is mentioned in the UN Charter : the first Article(the second paragraph) and Article number fifty-five, and also this use based on the right to development , in the folds of this right these countries have a fair part from the universal economic and social well-being , one of the – peaceful use of nuclear energy - legal fundamentals is The Treaty of The Nonproliferation of Nuclear Weapons on 1968. The study of the peaceful use of nuclear energy had been centered only with the Middle East where the international community and all the countries of this region are waiting for the Israel's nuclear superiority , at the same time a lot of legal researchers and political analysts warned of the lack of strategic balance in the region. Also the Middle East region considered as the most tension region in the world , that is why all the international efforts trying to make it as a nuclear-free zones and the last effort was the USA President's proposal in May 1991 about the reduction of weapons of mass destruction in the Middle East, and working to achieve the stability in the region, however ; this proposal hints at the use of double standards in dealing with the countries of the region. The entering of Arab Middle East countries to the threshold peaceful use of nuclear energy no longer just a desire to acquire advanced Technology, but become an absolutely necessary not only to diversify the energy as much as explain the march of overall development in these countries , also Iran and its holdings of an economic and military and geo-strategic elements ligible to be an important part in regional and international policies and so normal that her aspires are playing an international and regional role commensurate with its power where she has sought to acquire peaceful nuclear energy in order to deter the Israeli ambitions in the Middle East . In addition to the foregoing ,and through the study of the subject of nuclear power, whether peaceful or military we concluded that it has become necessary issuing strict international laws to oversee the proliferation of nuclear energy in order not to fall in the hands of terrorist groups.
